Nick Diaz not done challenging NAC’s ruling regarding suspension

Not much has been heard from UFC welterweight Nick Diaz since being handed a yearlong suspension from the Nevada Athletic Commission when the Stockton scrapper tested positive for marijuana metabolites after a February fight with Carlos Condit. While Diaz is known being a private person preferring to stick to the gym rather than the spotlight, his legal team has been extremely active as of late including an appearance yesterday inside a Las Vegas courtroom.

According to a report from the Las Vegas Review-Journal, Diaz’ attorney has filed a motion requesting the “first available court date for a review of the NAC’s decision with the goal of getting back in the cage before the end of 2012.”

The point of contention between the sides involves Diaz having marijuana metabolites in his system rather than active THC. Such metabolites are not considered a “banned substance” according to NAC policy, though the regulatory board has argued Diaz’s admission of having smoked pot is a violation in itself.

The 26-8 Diaz has been a longtime advocate of the benefits of marijuana and never shied away from acknowledging his own use of the substance. He has a prescription for medicinal marijuana in California, admitting he smoked it leading up to his fight against Condit but stopped eight days out as he has in other instances he was not penalized for.
